ESOS Phase 4 is the fourth compliance phase of the UK’s Energy Savings Opportunity Scheme (ESOS), the mandatory energy assessment scheme for large organisations. The Phase 4 compliance period runs from 6 December 2023 to 5 December 2027, with a qualification date of 31 December 2026 and a compliance deadline of 5 December 2027.

Organisations in scope must measure total energy consumption across buildings, transport and industrial processes, conduct energy audits, identify cost-effective energy saving opportunities and submit compliance notification to the Environment Agency.

Early preparation for ESOS Phase 4 requirements helps reduce compliance risk, avoid financial penalties and align energy strategy with wider net zero and decarbonisation objectives.

ESOS Phase 4 Deadline

The ESOS Phase 4 compliance deadline is 5 December 2027. The four-year compliance period began on 6 December 2023, allowing organisations to begin preparing audits, data collection and action planning well in advance of the submission deadline.

Who Needs to Comply with ESOS Phase 4?

Organisations must comply with ESOS Phase 4 if they qualify as a large undertaking on the qualification date. This includes companies that are:

  • Registered or operating in the UK
  • Employing 250 or more people, or
  • Reporting an annual turnover exceeding Ā£44 million and an annual balance sheet total exceeding Ā£38 million.

Organisations that are part of a corporate group containing at least one large undertaking may also fall within scope.

What can we Expect from ESOS Phase 4?

  • Display Energy Certificates (DEC) and Green Deal Assessments have been removed as a route to compliance
  • Progress against action plan commitments are to be included in the ESOS assessment
  • Where action plan commitments have not been met, participants must provide an explanation

This enables companies to proceed with fulfilling their compliance obligations, conducting energy audits, and updating their action plans without concern for additional regulatory changes affecting the completed work.

Department of Energy Security and Net Zero (DESNZ) will update ESOS guidance with these minor changes in due course, with the Legislative updates and MESOS Reporting System enhancements expected by early 2027, ahead of the Phase 4 compliance deadline on 5 December 2027.

Voluntary reporting of net zero assessments to new PAS (Publicly Available Specification) standards that have been developed with the British Standards Institution (BSI) will be possible in Phase 4. The new standards include a process for combined energy and decarbonisation assessments and outline the competencies for lead assessors and assessment teams.

The start of the ESOS Phase 4 compliance period began on 6 December 2023, our expert energy ESOS consultants are knowledgeable and up to date with ESOS compliance legislation and what will be required from organisations. Throughout your review we will help you collate data for your building, transport, and process energy use, analysing the data and reviewing your portfolio.

We will carry out your building’s energy surveys, produce the ESOS survey reports and ensure you can maximise the benefits of the scheme through conducting the ESOS review, verification and sign off. Our team of lead assessors will include any necessary changes to your audit and report introduced to the scheme by the Environment Agency.

The deadline for Phase 4 of the ESOS scheme is 5 December 2027, with a compliance period of 6 December 2023 – 5 December 2027. However, it is never too early to get started, site energy audits can start from January 2024. If a qualifying organisation misses the deadline, they can expect to receive a fine. Fines start at Ā£5,000 up to Ā£50,000, plus a Ā£500 daily penalty for continued non-compliance up to the value of Ā£40,000.
